UPDATE: Connection confirmed in drug arrests of two Clay County residents

Clay County, Ky. (January 16, 2019) - According to court documents obtained by ClayCoNews: On January 12, 2019,  US Forest Service Officer Hershal A. Neal was patrolling Britton Branch Road in Clay County, Ky. when he contacted two males sitting in a parked vehicle beside of the road.

The two individuals were identified as:

Roger L. Hoskins age 55 (Driver and Owner of the vehicle)

Austin R. Smith age 19 (Passenger) 

Hoskins stated that they were waiting on his mother to bring him some money.  After talking to the subjects, Officer Neal asked if there was anything illegal in the vehicle and both subjects stated, not that they knew of. 

Hoskins then walked back around the vehicle and was observed throwing something on the ground behind the vehicle.  Officer Neal asked Hoskins what he threw on the ground, he stated some paper then he stated a marijuana joint.  Both subjects were then detained. 

Nothing was found on the ground.  Officer Neal patted down Hoskins and located inside his coat pocket was a cigarette pack that contained a brown cigarette that Hoskins stated was Marijuana. Officer Neal then had his K9 that is trained in illegal narcotics detection sniff the exterior of the vehicle and the K9 alerted on the drivers side door.  The officer then had his K9 sniff the area where Hoskins threw something on the ground and the K9 located and alerted on a glass pipe that contained a white substance inside of it.

The interior of the vehicle was searched and located in the console was a small plastic container that contained a small clear plastic bag containing a crystal substance that field tested positive for Methamphetamine.  Hoskins was then placed under arrest charged with:

  • Possession of a Controlled Substance – First Degree – First Offense – Methamphetamine
  • Possession of Marijuana
  • Drug Paraphernalia - Buy/Possess
  • The Methamphetamine was located in the center console beside of where Smith was sitting and no one would admit to who it belonged to. 

    When Officer Neal searched Smith, found in his right pants pocket were two small plastic baggie corners that was cut the same way as the small baggie the Methamphetamine was located in.

    Austin smith was arrested charged with:

  • Possession of a Controlled Substance – First Degree – First Offense – Methamphetamine
  • Both subjects were transported to the Clay County Jail by KSP Trooper Gay.

    ARRAIGNMENT:

    On Monday January 14, 2019 both Hoskins and Smith appeared in Clay County District Court before the HON. HENRIA BAILEY-LEWIS. 

    Both entered NOT GUILTY pleas and were released on bonds.

    A Preliminary Hearing is set for each subject on January 28, 2019 in Clay County District Court.
